Constitutional Carry Passes House

The South Carolina House of Representatives passed H. 3594, Constitutional Carry Bill on February 22, 2023 by a vote of 90-30.  This bill will make it legal for all citizens of South Carolina to a carry firearm, open or concealed without a permit.  York County Representatives David O’Neal, Brandon Guffey, Heath Sessions, Tommy Pope, Dennis Moss, and Randy Ligon voted in favor of the bill, and Raye Felder abstained to vote.  The bill has the following restrictions as to where a a firearms can be carried,

      (1) law enforcement, correctional, or detention facility;

      (2) courthouse or courtroom;

      (3) polling place on election day;

      (4) business meeting or office of the governing body of a county, public school district, municipality, or special purpose district;

      (5) school or college athletic event not related to firearms;

      (6) daycare facility or preschool facility;

      (7) place where the carrying of firearms is prohibited by federal law;

      (8) church or other established religious sanctuary;

      (9) medical clinic, doctors office, or any other facility where medical services or procedures are performed, unless expressly authorized by the employer;

      (10) residence or dwelling place of another person; or

      (11) place clearly marked with a sign prohibiting the carrying of a concealable weapon on the premises in compliance with Section 2331235. A person who violates a provision of this item, whether the violation is willful or not, only may be charged with a violation of Section 1611620 and must not be charged with or penalized for a violation of this subsection.
